Legal Counsel Office, CCPIT (hereinafter referred to as “Legal Counsel Office”), owns rich experience in dealing with arbitrations and lawsuits concerning foreign-related business, and providing legal advices for international business cooperation. We provide the following legal services for domestic and foreign parties.

1. Acceptance of enquiry and claim raised by domestic and foreign enterprises

Legal Counsel Office is in charge of receiving enquires and claims on legal issues, trade disputes, commercial fraud encountered by Chinese and foreign enterprises during international trade activities.  Based on case details and legal relations, Legal Counsel Office provides clients with cost-effective, time-saving and efficient solutions. We established   databases of “increditable enterprises” and “creditable enterprises”, which are public for enterprises’ check.

2. Permanent /Specialized Legal Consultancy

Legal Counsel Office provides commercial legal counseling concerning foreign-related business cooperation for various entities such as domestic and foreign enterprises, government departments and social organizations. Our professional legal services include decision consultancy, project negotiation, contract review, risk control and dispute resolution. In accordance with customer’s demand, we can provide permanent or specialized legal advices.

3. International Commercial Arbitration and Litigation

We are very familiar with international commercial laws and rules, and to augment the resource of our international practices, we maintain close working relationships with local and foreign law firms throughout the world. By leveraging our worldwide legal service network and resources, we handle many litigation matters for both Chinese and multinational corporations that arise in the course of investment and trade, including arbitration and lawsuit, both in China and other jurisdictions, and assistance with litigation. We are also asked to advise on selection of foreign law firm or lawyer, to supervise on lawyer’s services and to provide litigation strategy as well as evaluation of legal process and risks, which may efficiently and effectively protect the clients’ interests. 

4. Urge of contract performance in international trade

Upon application by parties involved in foreign-related commercial disputes, basing on our examination to the fact and applicable laws of disputes, we will send a letter to the party which breaks the contract, as well as the cooperative chambers where the party breaking the contract is located, urging it to perform the contract or to submit traversing note. For the enterprise, who does not perform the contract without any reason or has no response to the Urge of Performance Procedure, CCPIT Legal Affairs Department will list it as bad-credit enterprise for key supervision and communicate it to relevant organizations.

5. ATA credit evaluation

We may carry out credit evaluation for the purpose of lessening the ATA Carnet holder’s burden of paying the guarantee deposit. The ATA issuing body under CCOIC may reduce guarantee deposit according to the result of the credit evaluation. This is helpful to lessen the ATA Carnet holder’s burden of paying deposit, and simplify application formalities.

Legal Affairs Department (LAD) provides entities with commercial legal services, including but not limited to:
