Since the CCPIT issued the first force majeure certificate on 2 February for COVID-19, they have also created a compilation of typical cases, and assisted companies to effectively use the force majeure system and to safeguard their rights and interests.

As of 3 March, 101 commercial certification authorities in the national trade promotion system have issued a total of 4,811 certificates of force majeure, involving contracts with a gross amount of approximately 373.7 billion yuan.

The concept of force majeure law and its application and scope is obscure to some enterprises. To clarify it, CCPIT has compiled a summary of typical cases where enterprises applied for the certificate over a period of time and published the CCPIT force majeure certificates case compilation.

The compilation details the review criteria and detailed requirements for issuing certificates on quarantine measures, delayed resumption of work, restrictions on entry, flight cancellation, port restrictions, withdrawal of travel agencies, performance of notification obligations, expropriation of medical materials and web certification, etc., to help enterprises understand the certification process and guide them to reasonably invoke force majeure and minimize the damage brought by the outbreak.

Furthermore, CCPIT recently issued the Notice on the strict regulation of the issuance of force majeure certificates on the delayed resumption of work to all local certification agencies to further strengthen the certification issuance regulations, clarify detailed requirements on review standards and evidence structure, thus improving the credibility of CCPIT force majeure certificates and providing protection for enterprises to correctly invoke force majeure rules to reduce losses.
